These Terms of Service ("Terms") govern your use of WayFur ("we", "us", "our"), including our website and app (the "Service"). The Service is provided by Delphi Rose Consulting Incorporated under the WayFur brand. By using the Service, you agree to these Terms. If you do not agree, please do not use the Service.
WayFur is an AI-powered travel planning tool that generates personalised itineraries for users travelling with their pets. Itineraries include suggested accommodation, activities, dining, pet services, and emergency vet contacts based on your destination, travel dates, and pet profile.
You must register an account to use the Service, including the readiness checks. No payment is required to create an account.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at info@wayfur.app if you suspect unauthorised access.
You must be at least 18 years old, or the age of majority in your jurisdiction, whichever is greater, to create an account. If you are under this age, a parent or guardian must create and manage the account on your behalf and is responsible for all activity under it.
Itineraries are generated by an AI model (Anthropic Claude) and are provided for informational and planning purposes only. They are not a substitute for professional travel, veterinary, or legal advice.
While we strive for accuracy, AI-generated content may contain errors, outdated information, or suggestions that are not suitable for your specific pet or circumstances. You should independently verify:
We are not liable for indirect or consequential losses arising from reliance on AI-generated content, for example travel disruption or fines resulting from unverified venue or regulatory information. Nothing in these Terms limits our liability for negligence in the core operation of the Service, death or personal injury, fraud, or any liability that cannot be excluded under applicable law.
Some itinerary content is enriched with real venue data from Google Places API. Venue details, including pet policies, opening hours, and contact information, may change without notice. We do not independently verify this data. Always confirm details directly with the venue before your visit. If you encounter demonstrably incorrect venue data, please report it to us at info@wayfur.app.
You agree not to:
We reserve the right to suspend or terminate accounts that violate these Terms.
You own the data you submit to the Service, including pet profiles, trip details, and saved itineraries. By using the Service, you grant us a limited licence to store and process that data solely to provide the Service to you.
We do not claim ownership of your content and will not share it with third parties except as described in our Privacy Policy.
Your personal data is processed in accordance with Canada's Personal Information Protection and Electronic Documents Act (PIPEDA), the UK Data Protection Act 2018, and, where applicable, the EU General Data Protection Regulation (GDPR). You have the right to access, correct, port, or delete your personal data, and to object to or restrict certain processing. For full details of how we collect and use your data, and how to exercise your rights, see our Privacy Policy.
All content, design, code, and trademarks of WayFur are our property or licensed to us. You may not copy, reproduce, or distribute any part of the Service for commercial purposes without our prior written consent. Fair personal use, such as sharing your itinerary with friends or family, is permitted.
To the fullest extent permitted by law, WayFur shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including loss of data, travel disruption, or financial loss resulting from reliance on AI-generated or venue content.
Nothing in these Terms excludes or limits our liability for: death or personal injury caused by our negligence; fraud or fraudulent misrepresentation; breach of your statutory consumer rights under the Consumer Protection Act, 2002 (Ontario), the Consumer Rights Act 2015 (UK), or equivalent applicable consumer protection law; or any other liability that cannot be excluded under applicable law.
We implement reasonable technical and organisational measures to protect your data. In the event of a personal data breach, we will notify affected users as soon as feasible after becoming aware of the breach. For UK and EU users, notification will occur within 72 hours in accordance with GDPR. We will also notify the relevant supervisory authority where required by law, and provide guidance on any recommended steps.
The Service relies on third-party providers including Anthropic (AI generation), Google Places (venue data; your destination name is sent to Google's servers), Supabase (data storage), PostHog (product analytics, with your consent), and Upstash (rate limiting). We are not liable for outages, errors, or data loss caused by these third parties. Your use of their services is also subject to their respective terms of service and privacy policies.
We aim to keep the Service available at all times but do not guarantee uninterrupted access. We may temporarily suspend the Service for maintenance, updates, or reasons beyond our control. We are not liable for any inconvenience or loss caused by downtime.
We may modify, add, or remove features of the Service at any time. Where changes significantly affect existing free users, we will provide at least 30 days' notice.
Trip Pass is a one-time payment for 30 days of Pro access for a single trip. It does not renew and there is nothing to cancel.
Annual is a recurring subscription, billed once per year in CAD plus applicable tax (HST), and renews automatically at the end of each 12-month period unless you cancel before the renewal date. You can cancel anytime from your account settings; cancelling stops the next renewal but does not end your current access — you keep full Annual access through the end of the period you already paid for.
We do not offer refunds for any unused portion of a Trip Pass or Annual period, including after cancellation.
If our pricing changes in the future, a Trip Pass or Annual subscription you've already purchased keeps the price and terms it was purchased under for its full term.
You may stop using the Service at any time. To delete your account and all associated data, email us at info@wayfur.app. We will process your deletion request as soon as feasible, typically within 30 days. Self-serve account deletion will be available in the app shortly.
We may suspend or terminate your account if you breach these Terms, with or without prior notice depending on the severity of the breach.
We may update these Terms from time to time. Material changes, including new fees, changes to liability terms, or changes to your rights, will be communicated to registered users by email or via an in-app notice at least 30 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
These Terms are governed by the laws of Ontario, Canada. Nothing in these Terms limits your statutory consumer rights. If you are resident in Canada, the Consumer Protection Act, 2002 (Ontario) applies. If you are resident in the UK, the Consumer Rights Act 2015 applies. If you are resident in the EU, GDPR and your national consumer protection laws apply. You may bring claims in the courts of Ontario or, where your local consumer protection law grants you the right, in the courts of your home jurisdiction.
